That raises a few questions,
How could they prove an implied contract?
Can the ability to bring claims in their own name be implied?

All something a judge would need to decide on. The more I read of your thread as posts unfold, they seem to reveal something new almost each time, the more I would urge caution before you pull the jumbo’s joystick back and become airborne on this.

How could they prove an implied contract?
