    None of that changes any of the entirely correct advice you've already been given. Time to put your negotiating face on.

    She had forgotten she was renting a house out and didnt have a copy of our agreement
    Told me let me know which month we would be leaving and she'd keep the deposit
    She would write me out a letter terminating our tenancy and post it

  • Sounds like you got an agreement from the LL. perhaps they think they could get a higher rent payment anyway from a new tenant. I would give one months notice from the day of exchange and not before as until exchange, no date is firm.

    How much is your deposit? If it were me I would have probably said fine, but as long as you covered all the remarketing costs etc. Depending on how much your deposit was this might not actually be much different. So yeah, she could have been much more unreasonable. Just don't give her notice until you've exchanged! Tricky part will be agreeing a month between exchange and completion with the rest of the chain. If worst comes to the worst much better to have a couple of weeks overlap and be paying rent and a mortgage rather than potentially being homeless!

    Be grateful.

    Wait till you've exchanged contracts (NOT before) then write giving 1 months notice)

    Either accept there will be an overlap between tenancy and purchase, or arrange a 1 month gap between Exchange and Completion.

    Sounds more like they were caught on the hop and need time to go back and look at their own contract. Probably put the whole thing to bed mentally when the house was let out on a 5 year agreement.


    The OP needs to be patient (which is not apparent in the repeat request for help within 30 mins of the original post). This will all take time to resolve to satisfaction of all parties (OP, landlord, vendor).

    As an aside wouldn't a 5 year tenancy have to be executed as a deed?
  • Landlords havent been the best...
    Im actually quite sad that we've been treated as we have...
    Been to professionals several times over how the LL has treated us previously during this new tenancy.
    Left in winter with no heating
    Roof coming in before birth of child and told to deal with it ourselves.
    Our neighbours are quite noisey too

    and an online tenancy pack
    Because we hardly speak shes completely forgotten about us which technically speaks volumes

    im really glad we havent got to rent again
