Hospital Disabled Bay Parking Charge

Driver received a parking charge notice from gemini for parking in a disabled bay at a hospital. Driver purchased pay and display ticket and may not have been aware they were parking in a disabled bay due to unclear signing. However, they were taking a patient, who has a condition listed as a disability under schedule 1 part 1 section 6 of the Equality Act 2010 to an appointment. Am I correct in thinking that as the occupant of the vehicle has a disability as defined by the equality act the driver could rightfully park in the bay? Emailed PALS and hopefully they cancel the charge, but just in case for the initial appeal would it be better to use blue template in the newbies thread or adapting what 4cr and CM have written in the "Disabled Ticket supposed letter from Motability." thread? Thanks.

Do you not need to be displaying a valid disabled badge to park in a disabled bay regardless of the occupants?0 -
