  • Ok. But the thing is they are responding by saying I need phone up to sort out the transfer of the money, but I have already done that over two weeks ago (money transfer should take 2-5days). They are not acknowledging that I have already done it and not received the money and they are not acknowledging that I could have damage on my credit file because of it. Regardless of how many times I say this to them they still send me the same “copy and paste” response.

    Next time you phone, try confirming the call in writing.

    I'd get what you can from them first, then send a letter before action for the rest.

    It sounds like you are being messed around.

    If you are owed money by CPW and they are not promising prompt payment, I would immediately issue a letter before action giving 14 days for payment (this is what you are required to do under the court rules on pre-action conduct). If no payment within 14 days go ahead and issue a small claim. There is an extremely high chance that they will sort themselves out as soon as the small claim hits their doormat.

    Don't bother trying to claim for 'stress'. The courts won't award that. Just stick to claiming for money you are owed.

    I agree with the other poster who implied that you shouldn't be spending £41 a month on a phone contract in your financial situation. Don't be fooled into taking expensive contracts to get a 'free' handset - the handset is not free. Could you keep your current handset and get a SIM only contract for half the price?
