    At least they have followed correct procedure and notified you that you owe the money. And you DO owe the money, so pay it ASAP before they initiate court action to recover it ... you'd then be liable for their court fees too (plus reasonable expenses).

    therefore the suggestion that I had not advised them to cancel it speaks for itself. My mistake was assuming my bank had full entitlement to these funds as I also pointed out several proven attempts to repay my bank assisted by my branch manager proved fruitless. I propose to ask the ins company for a copy of their complaints procedure. I have no objection to their entitlement but I will indeed seek an admin fee under the circumstances.

    You're going to complain now, 12 months after the fact?

    It seems to me that the insurer's original error was simply that, and was rectified immediately. On the other hand, your keeping the 2nd refund for a year could be seen as dishonesty.

    You should have asked about compensation for their error 14 months ago rather than sitting on your hands, hoping they wouldn't spot the double refund so you'd be quids in.

    Anyway careful how much money you keep back for your 'admin fee', too much and as others have said you could end up in the small claims court.

    What’s the issue? You’re not out of pocket. You’re simply trying to pull a fast one. You’d be howling if they had charged you twice.

    Why do you need a copy of their complaint proceure? It's not difficult to make a complaint.

    Either write to them advising you are making a complaint, or ring them up and tell them you wish to make a complaint.

    Include details of why you are making the complaint, and what you want by way of an outcome. Then sit back and wait for their response.

    So he can look like he's acting tough and confounding the general advice he's getting on here, which is what he doesn't want to hear. He's pretending to be taking action rather than admitting he's in the wrong.

    Did you ask them to read and agree to your terms and conditions when they took the payment 12 months ago, or did you just make it up on the spot?
  • When my existing motor ins policy was due to expire I received a quote which was unacceptable.As they had No auto renewal mandate I phoned the company to tell them I would NOT renew and I would seek an alternative quote. I had a quote from RAC ins services the following day on similar terms and paid by visa debit over the phone for a 12 month fully comp policy. 10 days later I attempted to buy groceries and my card was declined. I tried to obtain cash from an ATM using my debit card again without success. the next day I received a letter from my original insurer thanking me for insuring my car with them for another year!!!!....I immediately realised they had debited my account without my authorisation or knowledge. And in so doing had created a chargeable overdraft on my account and in addition an unwanted (Twinned policy) My bank refunded the debit immediately in accordance with current banking law and a payment recovery order requested. The company (or their bank) appear to have responded ASAP, BUT also credited my bank account several days later by mistake.After 14 months they are asking me for re-imbursement!! I fail to see how I can be held responsible for their catalogue of errors?? can you?
