❗❗PCN on Double Yellow but no T-Bar?!❗❗

I was hoping to fight a PCN for being on a double yellow as there was no T_bar terminating it

But am I right in thinking that there's been a new variant slipped in into Diagram 1018.1 that refers to Variant 3 in Part 5, namely "the transverse mark at the end of the line may be omitted" ?

Sly ****s if so!

Thoughts / interpretations on the new regulations anyone?

Well you won't have been able to win over 'no T bar' for a good couple of years already IMHO, because the trend has been for Adjudicators to take the view that a line that looks like a line is 'substantially compliant'.

However, almost every PCN from a Council can be appealed and won with help from pepipoo forum:

    http://forums.pepipoo.com/index.php?showforum=30

Read a few threads to understand what they do, read similar cases if you can find them, learn about exemptions on double yellows, and about Traffic Orders. Then register (NO Hotmail emails allowed!) and post a new topic showing them the PCN - both sides please, all small print on the back too, just cover the PCN/VRN on the front to protect your ID.

DO NOT wrote about the darn 'T bar' in your opening post or they will sigh and disappear. That ship has sailed.

You never know but it's worth asking them because over 90% of posters win.

Many cases are won on other issues, for example wrongly-worded PCNs, signs/lines that don't match the Traffic Order in place, or maybe something as simple as the car not being observed for at least 5 minutes to discount exempt activity like loading/unloading or dropping off a passenger, etc.

Loads of scope to appeal in most cases.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Broken, faded and missing T-bars was taken out of the TSRGD in 2014 ish.

I've recently had lengthy correspondence with a Freeman of The Land wibblehead on some lines that were broken as they were painted over a storm drain, so I learned quite a lot about the process.

I learned from the helpful and friendly chap at the council, not the deranged and shouty wibblehead. He was an utter loon.

  • Good to hear from you both!

    I wonder if this elaborates : http(colon)//bit(dot)ly/2lncNQT

Photo 1 is the actual 'contravention' in my black audi, Photos 2a & 2b show a wider view of the area on another day (today) where the black car (today) is where the red car was in the original. Then I have posted the PCN too above at the BitLy link as I wonder if that in itself is compliant.

The reason for the contravention was I thought the lack of T-Bar (at the end I parked) meant it wasn't a compliant line but I have since learnt - to my chagrin - that this representation seems on its own inadmissible these days.

Also, more of the reason behind my parking overnight like this is that there is literally no parking in our neighbourhood at all now, given the council in their spurious wisdom have double-lined everywhere, without even any exceptions at night time for residents to park. They have double-lined areas that really didn't need it and as a result we have lost about 7 parking spaces on our road :-/ It's like they are forcing us into parking unlawfully. Not sure if that has any weight or whether a Traffic Order is a Traffic Order, that's if one exists. They certainly never posted any public notices to give us any warning that they were going to double line the area :-/
