ParkingEye fine for a scrapped vehicle

Hello all!

Before anything else, I did read the newbies section, took me a while but I went through it. I also searched for a thread with a similar problem, but haven't found one.

I have received a reminder via post (no windscreen ticket) from Parking Eye and appealed on a technicality (no NTK, the first letter ever to arrive was a reminder 3.5 weeks after the alleged incident on 17.09.). Of course they rejected it and gave me a POPLA reference number.

Now, before I write an appeal to POPLA, I want to ask some things:
1) I never received the NTK, just a reminder and when I appealed I refused to name the driver - is there any way of proving that I haven't received anything before the reminder?
2) Less than a week after 17.09. I was in a car crash and my car has been scrapped by the Essex police - Considering the car doesn't exist anymore (need to inform DVLA, haven't done it yet because I listen to my husband who said they will be informed but gov page says I need to send a part from the log book or smth) can I still be held accountable for a notice where the driver is not named?

I also noticed on the newbie post something about the golden ticket, as in POPLA not being mentioned on the back of the reminder. I believe I haven't seen it on mine, but am not 100% and will have to check when I get home (typing this from work as usually have no time when home). Is that a point I should mention when appealing?

Appreciate any help or advice you can give. Let me know if you need any more info :)

    The fact that the vehicle has been scrapped since the alleged incident is irrelevant.

    1) nope, all they have to do is prove they posted it , it is deemed "arrived" 2 days later

    2) irrelevant , as it was NOT SCRAPPED on the day of the incident

    I believe you mean the POFA (not POPLA) paragraph was absent, in which case , GOOD , golden ticket

    you should have used this appeal I rewrote recently , removing the clause #13 grace periods part

    BUT , as you now have a popla code, construct a popla appeal based on the usual suspects from post #3 of the NEWBIES sticky thread

    include POFA2012 failure , yes
    no landowner contract
    poor and inadequate signage
    not the same as beavis
    any BPA CoP failures

    and anything else

    There is a date on the reminder, 28th September which I assume should be the posted date of NTK, adding 2 more days for "delivery" it gets to 15 days later

    And I just checked, no POFA mentioned anywhere :D

I did not see that bit anywhere and I just went back and used the find option on the Newbie thread. If it is in fact mentioned somewhere, please post it as I really did not see it anywhere

    Oddly enough not NOW being the RK is irrelevant.
    Its who was RK at the time that is the starting point, as RK is presumed Keeper unless shown otherwise.

    Otherwise if you got flashed by a speed camera you could sell your car before the notice comes through....

    NO IT ISN'T. AND YOU DO NOT NEED SPECIFICS - FORGET THE DETAIL, THESE CASES ARE ALL THE SAME.

    You are being told the bit about the car being scrapped is covered in the first part of the NEWBIES because it tells you your case is the same as everyone else's, which it is.
