  • If this was to go to court would we incur any further charges, such as legal fees, or would it just be for the £150 parking charge?

the parking charge will be £100 or less, not £150

a typical court loss , including fees, is about £175 , to be paid within 28 days to avoid a CCJ and so to avoid wrecking the credit rating

the parking charge was NOT £150 , that is an inflated charge , the figure was £100

if you go to court the max they can claim is £100 + a max of £50 solisitors + I think its £25 for the paperwork ,

so , look at it this way either you give them £150 in there hand for doing nothing , or you turn up , fight them with a good chance of winning**

at this point they have payed £75 out , to get £175 = £100 and work to do

** the admittance that the terminal was faulty and acceptance that they would pay some of the "fine" (ouch) would be dynamite in court , be sure to state that you will be relying on this (and others) in your written defence

It is well-established case law that, in the event of legal action, your company would be liable for the full costs of the claim regardless of outcome
    Really?
If Roxburghe are now dealing with the notice I suggest that you pass my challenge on and alert them to its urgency
Where did you drag this up from? Did you check the date of post containing it before just simply copying it?

Roxburghe went out of business (their demise hastened by pressure brought by the parking forums) almost 4 years ago.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
