Help - credit card payment not authorised

Hi everyone,


My partner and I are going through a dispute with BP due to some damages their machinery caused to our rental car. I won't go into all the details of that, but on return of the car, we paid the fees due to the damages and are trying to claim those back.


Any who, 3 days ago (over a month after we hired and returned the car), my partner's credit card (Capital One) is charged about 40euros by Interrent Malaga Airport, where we hired the car from. We did not authorise this payment.


My partner only noticed this had been taken after he received an email from Capital One advising his credit limit would be raised in a few months, and not to go over his limit before then or he wouldn't get the raised limit. He decided to check his card, and found out he was not £40 over his limit due to this unauthorised payment.


He rang Capital One to explain, and they advised as long as he made payment before 1st December, he would still get his credit limit increased, but other than that they could do nothing about the payment, as he'd previously made payment to Interrrent.


I don't think this is true, but don't know for certain. Can anyone advise us as to whether Capital One should be able to retrieve this money as it was wrongly paid?? We're trying to get in touch with Interrent, but surprise surprise they don't have a customer service contact number, only email so who knows how long it'll take for them to reply!


Any advice would be greatly appreciated! :)

    He wasn't over his limit before. I might have got the exact figures a tiny bit wrong as I don't have them in front of me, but he was not over his limit before. He was close yes, as we had to pay the fees to the rental company for the damages on his credit card but he was under his limit.


    Could you explain what you mean by a chargeback? I've not heard of this before.
  • It's where you dispute a charge and ask the card provider to reverse it with the retailer.

    You'll need to provide them with some detail re why it is unauthorised.
  • Firstly for a dispute of this nature on Visa or MasterCard you will need to contact Interrent Malaga Airport first to find out what the charge is for. Once you have the reason you can then try and dispute it.


    Bearing in mind its been a month and the low value there's a good chance its a fine - if it is you wont be able to dispute it.


    If its relating to something else, or you do not get a response from Interrent Malaga Airport then you should have a valid claim. However the final outcome wouldn't been known for 30/45 days (or longer) depending on the type of card you used.

    Reason I suggest a fine is these often take a while to filter though, whereas damage/fuel costs tend to be taken when the car is returned.

    According to their Ts & Cs for rentals in Spain, they charge renters €40.37 for a traffic sanctions administration charge, i.e. to cover their costs in advising the authorities who was driving a rental vehicle when any alleged infraction occurred. This is separate from any subsequent fine payable to the relevant authorities so there could be more to come if this is what they're charging for, but they (InterRent) should obviously advise you of this admin charge being taken....

    Read your car rental contract - does it mention anything about this charge?
