Parking Eye PCN Two Saints Retail Park Ormskirk

Could somebody please help me out....
I have received a Parking Charge Notice from Parking Eye for overstaying the free hour by 10 minutes which is ridiculous.
I have read the various threads and drafted an appeal letter (below), and would be really grateful for any feedback or advice offerd
Dear Sirs
Re: PCN No.
I challenge this 'PCN' as keeper of the car.
I wish to invoke your appeals process as all liability to your company is denied on the following:
1. Your signage does not comply with the BPA Code of Practice
2. You are not the landowner and do not have the capacity to offer contracts or to bring a claim for trespass
3. The driver was a paying customer when they parked at the retail park on that day.
4. The 10 minutes they were over was actually time taken to enter the car park, find a space, park the car, then return to the car, leave the space and exit the car park (on a Thursday evening directly after school in a busy retail park which includes McDonalds, Argos & Aldi).
5. The BPA code of practice states that you should allow the driver a reasonable ‘grace period.
There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.
Should you obtain the registered keeper's data from the DVLA without reasonable cause, please take this as formal notice that I reserve the right to sue your company and the landowner/principal, for a sum not less than £250 for any Data Protection Act breach. Your aggressive business practice and unwarranted threat of court for the ordinary matter of a driver using my car without causing any obstruction nor offence, has caused significant distress to me.
I do not give you consent to process data relating to me or this vehicle. I deny liability for any sum at all and you must consider this letter a Section 10 Notice under the DPA. You are required to respond within 21 days. I have kept proof of submission of this appeal and look forward to your reply.
Please issue your cancellation within 35 days of this letter, or forward a POPLA verification code.

The BPA code of practice states that you should allow the driver reasonable 'grace periods' both on arrival (the 'observation period' according to Kelvin Reynolds of the BPA) and then a minimum of a further ten minutes after the allowed parking time, to leave. Clearly you are in breach of the BPA rules in this case.
There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.

I would go with the above as the middle part, the rest the same as you had.
Was the PCN received within 14 days?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
