Excel Parking - Parked after expiry of time purchased

Hi

Just checking latest state of play on this. The driver (not me) got the PCN and I have NTK for £100. She overstayed 10 mins having paid £2.10.

On the basis of Cargius case, £100 for 10 mins extra seems excessive. From reading forums I am surprised to see Cargius not more quoted (after Beavis went other way) - although don't have any broken ankle or other extenuating circumstances! In this instance would happily pay small amount...

On their claims page it shows pictures of the car, plus one of expired ticket with time stamp, plus picture of sign - they seem to be learning about documentation at least!

Does that change the claim statement - e.g. to not mention the signage?

I am the keeper of the vehicle and am aware of your purported 'parking charge'. The driver will not be identified. I require the following information so that I can make an informed decision:

1. Who is the party that contracted with your company and are they the landowner?
2. Is your charge based on damages for breach of contract? Answer yes or no.
3. Please provide proof that the timing of any camera or timer used was synchronised with all other cameras and/or systems & machines.

etc...

Thoughts welcome!

It really doesn't matter what you put in your appeal.
You appeal will be rejected anyway.

Why do you not want to send the already written appeal in the NEWBIES thread?
What does it matter whether you think the signs are ok?
Don't try and do their job for them. Tell them the signs are rubbish and let them prove the are not.

As per the NEWBIES thread which I keep up to date at least every month.
From reading forums I am surprised to see Cargius not more quoted (after Beavis went other way)
That's why Cargius isn't used! Beavis was in the Supreme Court and wipes it out, pretty much.

    We agree.

But the in their infinite wisdom, in support of this notoriously anti-consumer and greedy cowboy (MPs' words in Parliament, I hasten to add) Capita-owned parking company (for whatever reason) the Supreme Court killed that argument. Beggars belief.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
