Adoption allowance and housing benefit

    This is an important question.

If at MR stage she must get advice from the CAB on how to proceed with the appeal.
They can do a benefit check for her.
Would PIP be appropriate for her?

    What has happened to CTC's?

HB and CTr can be paid if she completes a nil income form with her local council. She should do this asap.
Council tax credit has been stopped as well. I’m not sure what PIP is, but she is not and her doctor agrees mentally fit for work.

I think Alice meant child tax credit in her post, not "council tax credit". If your sister is not claiming child tax credit already, she should do so https://www.gov.uk/claim-tax-credits .

Also, you don't say how old the children are. If either is under 5, your sister can claim income support (instead of ESA or JSA) as she will be treated as a lone parent as husband in prison https://www.gov.uk/income-support/eligibility .

Did she get a FIT NOTE from her GP to certify she is unable to work?

Is she in a Universal Credit area?
  • Thank you so much everyone, I have forwarded her links and information, so we will make an appointment at citizens advice to work out the way forward.

She should sign on for JSA and jump through their hoops - after all, there are plenty of people desperate for a job, practising perfect answers for interviews.... even if she got an interview she could just "present as pretty useless" thus ensuring she wasn't hired.

As people who WANT a job can't get one .... it must be easy to just go through the motions and simply not be chosen.

If she just gives negative and whiney answers to questions at interview that'll be deed done!

You didn't answer my question about whether she's been to a full tribunal or not. If it hasn't got to that stage then she has to make sure she gets to CAB asap because there are rigid timeframes.
Unless I say otherwise 'you' means the general you not you specifically.

She said to me appeal, not tribunal, and it was declined, I will ask her what she meant, thanks.
