Perfect homes dliema

Hey new to this but really need some advice on what to do I have a huge problem with perfect home going on.
So over the past 3 years I have been a loyal customer with them here in Swansea but this year thier store closed due to refurbishment , I have 4 household items with them and an iPhone which has become the problem
I've took this iPhone out with them as I really needed a phone at the time but soon after the iPhone became damaged so as I have insurance on it that basically covers everything I returned it to get it Reapaired but it came back still not fixed so returned it again 3 more times before the Swansea store close and it still wasnt repaired so I rang the service centre and they sent a delivery guy to come and collect it 3 weeks ago to fix it , it got returned to me still broken, so rang straight away complained and they asked for it back so they can check again , so I sent it back , as it's been a week thier I rang the customer service centre to today and the gentlemen on the phone said it's not repairable so now they want me to take a new contract out on a new phone or stop paying for the iPhone and not have it back then throw away all the money I've spent on paying for it!! Is thier anything I can do so I don't loose out on the money I've paid?

    No, this is a hire purchase agreement, so a full refund would not be an option.

    According to the key terms, OP you have the right to either:
    You can choose to have the product replaced on a like for like basis and continue to pay for the goods as per the original Hire Purchase Agreement, or
    You can choose to have all future payments on the Hire Purchase Agreement waived following which the Hire Purchase Agreement will be cancelled.

    So your options are either a reconditioned replacement phone and continue to pay, or to cancel your agreement but no replacement. That is your choice, not theirs.

    Refer them to their key facts document if they won't allow option 1.

    How much have you paid and how much do you have left to pay? Their APR is 90%, you may be better off to cancel the contract and buy a phone elsewhere.

  • Ok thankyou for your help yeah I did request a full refund and they refused so I will try option 1 with them and see what they say , I've paid over £400 for the iPhone and still have a reaming £150 left to pay.

    The companies you contract with when purchasing the goods are temple retail ltd & temple finance ltd (who are both UK companies registered in birmingham). Therefore OP can rely on their consumer rights as they are laid out in the consumer rights act.

    OP has already said that the phone became damaged and was being claimed through the insurance not the retailer under consumer rights so boris has quoted the relevant terms

    Apologies to you & boris - I read it as being repaired under insurance as faulty. Completely missed the damage part.

    If its user damage then it will indeed be an insurance job.
