Advice on t and c

Hello all,

Looking for a little bit of advice on these terms and conditions of a private course I studied on but left for employment.

I started a programming course in June which cost £4,500 of which included a £500 non-refundable deposit. I chose to pay it modular which meant I paid £1,500 first part, £1,000 for the second part and another £1,500 for the third part.

I secured employment in IT by the end of week 5 so decided against carrying on studying. I left at the end of week 5 of the 16 week course.

By this point I had paid the £500 non-refundable deposit, £1,500 for the first part and £1,000 for the second part. I paid the second module fees on the Monday and left on the Friday.

I’ve been reading the terms and conditions with regards to a refund of the module 2 payment. It seems to have conflicting information. Perhaps someone can shed some light on it.

First part says:

Between the commencement and completion of module 1 (week 1 to week 5) you shall not be entitled to any refund of module fees or deposit paid but will not be liable for any further fees for module 2 or module 3.

Second part:

Within 1 week after the Module 2 or Module 3 payment date you shall only be entitled to a refund of 40% of the relevant module fee and you shall not be entitled to a refund of the non-refundable deposit. You will not be responsible for any further Modular payments, if any remains.

These two parts of the t and c make sense to me but they conflict. The payment date for module 2 was the beginning of week 4.

Does this not kind of make the first part of the above t and c a bit pointless in my circumstance?

I’m sure someone will understand it better than me.

    I read part one as referring to ONLY the fees for part 1, but NOT therefore the £1000 you have paid for the second module.

    The second part does not apply as you did not get to 1 week after module two.

    On this basis, I would say you are entitled to the £1000 back that you paid for module two.
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    Not the start date but the payment date which you say was the beginning of week 4.

    You left at the end of week 5 so not within a week of the 2 nd module payment date.
