So you now raise an MCOL claim against the PPC for your costs incurred by their negligence?
No!!
First write and ask for all your costs incurred over the set aside including the £255/harassment compensation etc. Send proof.
If they ignore you, then you can start legal proceedings but must first issue a lbcca, and only if that's also ignored move on to a mcol0 -
Wouldn't they say that the judge did not award those costs, which is why they are not liable.
It's definitely worth sending lbcca but I am thinking for the legal proceedings in the future.
Will need to make a proper case as I am sure involving a solicitor in this matter would cost me deeply.
Just want to know the facts and expenses before I proceed.

If contemplating a sol, why not try Gladstones - they offer a ‘no win, no fee’ arrangement. I’d like to see their reaction!

Indeed, and its small claims so you wouldnt get those fees back UNLESS you can show they have been unreasonable.
Really should have shouted about the set aside costs. Its a standard fee, the judge could have asked the C sol if these had already been paid, and made an appropriate order if there was any doubt.0 -
Any ideas or a template to send to Gladstone and PPM to recover the set aside and additional consts?
When court asked to send the witness statement Gladstone used my email address from the first appeal I made to PPM in 2014.
Not quite sure why they did not use my additional contact details I have mentioned in my appeal when they filed the case for the first time.
PPM must have noticed the change of name of the flat resident and change of car. It's a long shot but quite possible.0
