ok here goes
i have a tv repair plan to cover repairs/replacements
under the conditions of the insurance my tv must be repaired or replaced withinn a certain time limit
so my tv did go faulty and it was collected
it could not be fixed within the time limit and a voucher was issued for a new tv
i then went to the tv shop and bought the said new tv
all good
a few days later the old repaired tv was also delivered without me asking for it
this old tv was written off by the insurance i had
what is my legal standpoint regarding this old tv
i did not order it
i asked for it to be written off due to over the time limit for repair
i did not ask for the old tv to be returned to me

Have you contacted the insurers/repair plan providers to make them aware this tv has been delivered to you?
Generally they'll own the old goods if they paid out on a replacement. If that is the case, you're an involuntary bailee - you have a duty to take reasonable care of the goods and return them to their owner. I imagine if you contact them, they'll either arrange an uplift at their cost and your convenience or tell you to keep/dispose of the goods as you see fit.You keep using that word. this only got delivered friday evening
i was in work and my wife took old tv in
as its now the weekend, i shall contact them on monday working hours

Items that firms send to you, but you didn't actually order are called "unsolicited goods". You're well within your rights to keep them.
You have no obligation to send them back to the company or to pay for them. If a company demands payment, that's a criminal offence.
as i did not re order this old and they delivered it anyway after it was written off-is this not classed as unsolicited goods???0 -

Unsolicited goods are goods that are sent to you with the intention of you using/keeping them with no prior contact from you or anyone on your behalf.
As these were delivered to you under contract (even if it is by mistake) then they are not unsolicited.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -

It is a mistake.
Just notify them of the error and ask them to collect it at your convenience.Should've = Should HAVE (not 'of')
