CEL PCN County Court Claim

Due to family problems including a bereavement I am posting this with the hope of gaining advise to help my son.


Although I have spent many hours collecting lots of sound advice on the NEWBIES FAQ’s and through other threads I was hoping you would be kind enough to give some advice relevant to this case as he is under a great deal of pressure and must admit it’s getting to me, thanking you in anticipation.


My son received a £100 Parking Charge Notice from CEL for an alleged overstay registered by ANPR at a small retail car park in December 2016.


The driver and passenger did visit the retail park staying for a maximum of 30 minutes and left. The vehicle returned later that same day although with a different passenger to use a McDonalds drive thru and left after around 10 minutes after being served, the PCN states that the vehicle was parked for over 4 hours 30 minutes contravening a maximum 2.5 hours free parking.


Although it is now understood that he as the registered keeper should have responded due to incorrect personal, social media and forum advise he ignored all communication from CEL until he received a recent claim form in the County Court for over £325 which includes Interest, Court Fee and Legal representatives costs.


During the times the vehicle was supposed to be at the retail park my son visited a car dealer to discuss the possibility of part exchanging his vehicle which the car dealer inspected to arrive at a value, the dealer remembers my son and vehicle because it was his first business after returning from holiday the previous day and the discussion they had, he is willing to write a statement/attend court to that effect.


We have today registered a Gateway Account and acknowledged the notice with the intention to Defend All.
