Did not appeal and now have letter pre CC claim, help!?

I received a letter end of September from parking eye re 10 minutes I allegedly spent in one of their car parks in June and did not pay for.

They had sent previous correspondence to an old address and had got my current details from a credit reference agency. There is photographic evidence of my car entering and leaving the car park. I stupidly threw it in the bin and did not appeal and now have this letter before county court claim giving me 14 days to pay.

I cannot recall parking in the car park. They wanted £60 to cover the 10 minutes I spent in their car park? Can I do anything to avoid having to pay £100 to these vultures? I've tried to post on pepipoo forum but it won't let me. Any help much appreciated from a heavily pregnant and hormonal lady!

    Are you using a hotmail email address to register? It won’t work, try a throwaway Gmail account.

    Too late to appeal. You need to robustly respond to the LBC (the NEWBIES FAQ sticky, post # 2 tells you how to do this) then it’s a case of wait to see what PE’s next move is after that (probably court papers, which are defendable with help from here).

    From here on, post #2 of the sticky must be your go-to resource to guide you through the court process, from LBC to the actual hearing.

    Have you complained to the landowner and asked them to intervene and get this cancelled? Works quite often.

    In future posts would you put in some paragraphs as a wall of text, as per your opening post, is difficult to read. Some regulars won’t bother reading when faced with a ‘wall’.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • Thanks, I have no idea who the landowner is or how I find this out even. I did read the sticky post but will have a better look and follow some of the links, it was a little overwhelming!
  • Okay I'm still feeling confused. There must be a parking fine legislation degree I can take but I don't have time for that now. Are there solicitorswho take this stuff on?

    This is not a fine, it is an invoice for sillymoney damages for an alleged breach of contract, read what the BPA Code of Practice says about grace periods.

    Don't PAY anyone, that's money down the drain.

    NOW is you chance to *appeal* (sort of) then, by emailing ParkingEye NOW, and NOT saying who was driving.

    Ask for a copy of the PCN. DO NOT say you binned it. Just ASK for a copy of the PCN and where they posted it to.

    Ask if they believe they have complied with the POFA, bearing in mind any PCN may have been sent to the wrong address.

    Ask for a picture of the sign on site.

    Ask for a copy of the contract with the landowner, with the 'Grace Period' showing.

    Ask how they contend the BPA Grace Period rules (minimum allowance to be ten minutes, not a maximum) were followed.

    with the PCN number and 'reply to LBCCC - request for full information in accordance with the new CPR' in the subject line.

    and please edit your first post to remove info about who was driving (don't even say here). Don't mention it in the email!
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
