Expired?? Credit Agreement
Sorry I'm not sure I'm in the right place here but have a good question for you all, it's a bit long winded though.
Ok easter last year me and my partner decided we wanted to buy a new carpet (renovating a house so the plan was lay carpet as each room fininshed). So off we go to a reputable carpet chain. Picked a carpet, told sales guy what we wanted as wanted exact carpet throughout whole house, but not in a position to buy and store a whole house worth of carpet. Not a problem says he. He then goes on to explain that the store operate a scheme where you can buy all the carpet for your house, interst free over 2 years and don't have to repay anything until the LAST carpet is laid, even after we explained to him this could be another 18 months or so before we will need final carpet laid, not a problem says he. Bloody brilliant we think so go ahead fill out credit agreement pay £500 deposit. All good.
Anyway over the follwing 12 months each carpet gets laid various problems along the way, like they bring bed 3 carpet when they're supposed to be laying bed 2, don't reorder carpet that they cut into so last carpet couldn't be laid as they didn't have it!! etc etc
The major problem really starts though when we get a phone call in July this year saying that our credit agreement has been sent back from the finance company, some 15 months after it was originally accepted, as it has expired!? He said we should have started repayments with 6 months after ordering carpet! Not what sales guy sold the agreement to us as, but according to manager sales guy no longer works there.
To try and be brief, the manager said that we need to complete a new form, can we come in and sign it. Going on holiday so not possible will do after we get back. 3 weeks later we go into SIGN new agreement. New agreement not ready, manager has no idea of how to complete said forms. By the way the sales guy that no longer works there was there er selling carpets.
After 45 minutes of waiting we said we can't wait had a prior engagement will come back later to sign when he has it all done, then manager gets very aggressive saying we can't go until we have signed. We say we're going, he says it's our fault we didn't sign it we should have been paying we should have chased it up and then threatened to send it to his 'bad debt' department for refusal to pay! And then just as we were leaving he said well just put your bloody signature on this form and I'll complete it later!! Yeah right!!! No way would anyone in there right mind sign a blank credit agreement form.
Two days later he phones to apologise prefusely almost grovelling to say that he was having a bad day. Wouldn't speak to him told him to put everything in writing.
Sorry for the rant, but where do we stand legally with this do we have to sign this paperwork?? What happen now? the finance company has no record of an agreement with them so they won't be chasing us. So do we have to pay, I sincerely believe we have been mis sold the finance product from the beginning, but don't know where or what to do now, don't want a knock at the door wanting £2500 immediate payment.!
