As set out in your letter dated 29th August documents should have been delivered to each party and the court of which they are to rely on, on the day of the hearing.
I hand delivered my documents on the xxth September 2018 as requested and also have proof of delivery to the claimant’s representation via Royal Mail tracking. Since that date I have received nothing from the claimant or their representatives until the xxnd October, almost four weeks overdue. In the form of an email from the representative I receive information which also accounted for what had been stated within my documentation. Surely an unfair advantage and procedure by legal representation against myself who has abided by the timeline and tried to be fair for all parties.
I now have to review this information in four week less than anticipated, which hugely disadvantages myself with my busy work schedule and no professional legal representation. I am now at great prejudice to defend this case. I ask the court does not grant any relief from directions of the claim stating information to be received by xxth September and the documentation is struck from the case.
With professional legal representation this is wholly unfair and there is no excuse for the lateness of this information by the claimant.
I also ask that without the presence of a witness on the day to prove evidence of their unevidenced claim, the claim should be struck out. I would also ask the additional ticket referenced in my documentation which I expect they will try and pursue after this are also struck.

Just as an update. I went to court, waited around for far too long.
But went in and basically said as 'nosferatu1001' told me, that their witness statement had arrived after the required date and I wanted it to be removed from evidence. Without a witness on the day the case was thrown out. So I won, what a pain but happy in the end.0 -

As the Claimant did not submit a defence to my counterclaim within the usual 14-day deadline, I request the Court to award me the sum, i.e. £8,376, sought in my counterclaim by default.Please note, we are not a legal advice forum.
