Court Claim Help

Hi My partner received a ticket whilst stuck in a nail bar for overstaying her payment by 15 minutes, she received a ticket by post, and we asked them to consider the ticket due to mitigating circumstances (she was in the middle of a procedure and had a minor reaction , this then had to be removed, she usually parks at the car park for 1hour, and as the procedure normally takes 30-40 minutes to complete; the hour is normally ok, however due to the complication the procedure took longer and she had no one with her that could extend the parking as she could not to leave so they could be quickly removed,. a photograph was included of the appointment card to prove she actually visited the nail bar.

They objected the appeal saying she could have phoned up to let them know, but the number on the sign is an automated payment service only No Humans available!! . (£100 penalty)

She received a solicitors letter saying if she didn't pay up she would be taken to court, and sure enough claim arrived £330.19 (The original 1 hour stay costs £1

We have posted an AOS giving her more time to respond as she was away when the court docs arrived. Any help Kindly Appreciated..

    Which court? If you can't appeal, then you have no choice but to pay.

    The poster above appears to have misunderstood the stage you are in the process.

    If there has been an acknowledgement, then put together a defence. If you search for the name of the parking company, you will find defences appropriate to them.

    Of course people don't pay up at defence stage! We win 99% of defended claims here and the NEWBIES thread explains how.

    And often there is 'no appeal' because the entire thing from these 'cowboys' (MPs' word in Parliament, this year) is a scam.

    Do not contemplate trying to pay the £1 original ticket cost. It won’t change a bean.
