Claim Form

Hi, I'm a newbie to this forum and need help, I have looked through the newbie thread and couldn't find what I needed.
So whilst at University I got a few parking tickets, which I was told I don't need to pay, then the letters started coming so I searched up and was told to ignore them (bad advice now I know), after the letters from the company it was passed onto "solicitors" and other companies, which I carried on ignoring.
Now just recently I have received a Claim Form from County Court Business Centre.
I will attach the front of the letter I've received, so you guys can have a look yourself.
What would my next step be as I have no clue about this sort of stuff usually.
Any help would be greatly appreciated.
Thanks

make sure any documents you post on here have your personal details redated. And you can't post links yet so you'll have to change http to hxxp then we will activate it for you.

I have looked through the newbie thread and couldn't find what I needed.
Post #2 of the sticky gives you everything you need to start work on these, and takes you right through to your defence, witness statement and hearing.
I have no clue about this sort of stuff
You’re really going to have to up your game then and learn all about this stuff, otherwise you’ll be steamrollered and end up with a big bill.

How many court claims do you have? What’s the total amount they are looking for?
I was told I don't need to pay,
Did the Uni tell you this?
was told to ignore them (bad advice now I know)
From friends? Are they helping you deal with this now? Are they going to help pay any court costs you incur should you lose as a result of their ‘advice’? Tackle them!

From your scans of your court papers, it looks like PCM (UK) are the parking company. They are litigious, so expect these to go all the way.

But their Particulars of Claim (POC) are woeful and do not meet the new Pre-Action Protocol from 1/10/17 (PAP), so read up on this because you will need to challenge the rubbish, usual Gladstones template POC.

Have a read of this thread for the same area

In addition it may pay you to find out from the DVLA if PCM accessed your personal details on more than one occasion. This is to check if there are other potential claims in the system - or that there was some reason that PCM could not act until now. The signs at that site changed over the months.

  • Thanks for your replies, no the uni didn't tell me, other uni colleagues ignored them and nothing has come back to them. I cant seem to find a defence which includes the new PAP, which related to my claim. I have had a look at a couple and have an idea of what to write but still don't know where to start. If I could get a template which I can use then I could post my first draft of defence for you guys to assess.
    Thanks in advance

You haven't told us anything about your parking events so it is difficult to pick a particular sample defence for you - even if it were possible.

Post#2 of the NEWBIES thread has links to many defences.
Pick one that closely resembles your situation and adjust it to suit.

For example, as your court papers are dated in October, you will want to include the section of this defence (or something similar) that talks about the new Pre-Action Protocol that came into effect on 1st Oct 2017.

    Odd?

I can find several defences just by searching the forum for '1st October 2017 defence Gladstones'.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I’ll repeat my question from my post #4.
How many court claims do you have? What’s the total amount they are looking for?

The more you have, the more likely a court appearance

  • Okay thanks for your help guys I have Acknowledged the claim and will post up my defence once done. Thanks
  • And I had another quick question for you guys, once I file of the defence what is the next stage, does it go on to court hearings or will there be a settlement?
