Hi all, I haven’t responded to anybody yet but have drafted an email to send. I thought I’d get your expert thoughts on it first rather than just send it. The parking company is owned by two ladies by the way.
Dear madams.
On Saturday 14th of October, I received an NTK from yourselves ref the above number. I did send an appeal by email to yourselves on 4th September and received a reply of confirmation on the same day. There is no mention of this in your letter and the fact that you contacted DVLA to find the keepers name, even though I gave you the name and address of the driver, suggests that you have chosen to ignore the original appeal in order to extort more money from me.
. I will not be paying your demand for payment for the following reasons.
The BPA CODE OF PRACTISE ,
Operator Procedures 22.8 states they expect you to " ACCEPT OR REJECT THE APPEAL IN WRITING NOT MORE THAN 35 DAYS AFTER THE INFORMATION REQUIRED TO RESOLVE IT HAS BEEN RECEIVED". You have done neither.
The period between the date you received my appeal and information required and your acknowledgement of it and your next letter was 37 days, which is outside the BPA required time period.
There was insufficient signage,
The car park in question has no clear signage to explain what the relevant parking restrictions are. The signs are at a height and of a small enough size to be unnoticed. This means no contract can be formed with the landowner and all tickets are issued illegally. Please see attached photographic evidence I have gathered as proof. These signs of which you have added more, cannot be seen by motorists entering the parking area because whilst in charge of a motor vehicle, the driver is legally obliged to proceed with due care and attention and whilst looking out for other vehicles and small children, the signs are at a height and of a small enough size to be unnoticed. From the position in which I was parked and proceeding directly to Marks and Spencer, there are no parking rules signs visible.
The charge is disproportionate and not a genuine pre-estimate of loss
The amount you have charged is not based upon any genuine pre-estimate of loss to your company or the landowner, as the car park is FREE OF CHARGE. Please provide me with full details of expenses incurred by Park Watch or Broughton Retail Park Ltd as a direct result of my car being parked on Broughton Retail Park.
In my case, the £100 charge you are asking for far exceeds the cost to the landowner of Broughton Retail Park. I therefore feel the amount you are asking for is excessive.0 -
