Gladstone Court Summons- Defence Help

  • Sorry to jump in on your thread, I don't suppose anyone has any idea how far your expected to travel for a county coirt summons. My insurance company are trying to take me to court stating they overpaid me on insurance, despite this being settled twice already. 2 years later they pop up every 6 mths demanding money which of course i then go through an hour's phonecall and then get an apology and its resolved....until 6 months later and we're back again. Yet with a solicitor this time, we live in Cornwall, and have asked that the court be within a reasonable travelling distance as my husband suffered injuries in the car accident and cannot travel for more than say 60 miles. They have simply replied saying its near to where the claimant is. No idea where this is atm, just wondered if anyone knew how far we are expected to go ?

    A litigant in person gets to choose their own local court, if you get a claim from a corporate claimant.

    It's a question you get to tick and choose your local court, in the N180 Directions Questionnaire, after submitting your defence. No worries. Stop begging them for something you will get anyway, should they proceed.

  • Hi All Back Again


    I posted some while back regarding a small court claim from our beloved Gladstones.


    I wrote my defence and sent off, and requested that the hearing was not on paper, although it has now been allocated to small claim court and the judge has considered it suitable for a written hearing. It did have the option to request this orally (again), but I have stupidly missed the deadline for this (i thought it was the same date i had to file the papers Jan 3rd).


    I wanted to check;


    1) Is it imperative that this heard Orally or do i stand a chance on paper?


    2) I just wanted clarification that the original statement i sent in is the one I send this time round too?


    3) With Evidence, is there a right way to present this on paper. I have screen grabbed various reviews of the same carpark to further evidence that so many people have been stung in the same way, as well as companies house information in regards to Will Hurley and John Davies, it all looks a bit copy/pastey though, will this be an issue?


    I have read the newbie thread, regarding the beavis sign i need to send etc and have all that ready but ANY other helpful tips and hints would be greatly received.

  • Finally, i have spoken to the court on the phone who have advised I can submit an email requesting that this is heard orally (although may be ignored) but i must cite my reasons, would anyone be able to help with this also.

    You stand little chance on paper, IMHO.

    Email and say you wish to question their witness and have issues with their evidence, and lack of it, that as a litigant in person you really wish to air your questions at an oral hearing which is what you have requested all along in the interests of justice against this serial litigator, which files claims with no evidence whatsoever and relies upon the public to misunderstand the process, and not get a fair hearing.

  • phone them to say you're sending/have sent that email - in some courts emails are not read for 2 weeks!
