Compensation

I bought an television which turned out to be faulty.I asked for my money back or a replacement within the 30 days specified in the Consumer rights Act 2015.The retailer refused.A different retailer will sell me a new television of the same sort if I give him my faulty television & £500.The new television will not be in stock for a while yet so I will not pay the £500 until the new one is delivered to me.
Can I start small claims court proceedings now to recover the £500 or do I have to wait until I have actually spent the £500?

    How did you pay for the original TV? (Cash? Credit card? Debit card?)

    That’s not how the law works. If you choose to part exchange your TV you can’t just claim the extra you pay from the original supplier.

    When did you buy the TV?
    Who did you buy it from?
    Online or instore purchase?
    How much did you pay?
    How did you pay?
    When did you first notice the fault?
    What is the fault?
    When did you first contact the retailer?
    What exactly did they tell you?

    You have given no relevant info that can help you get the correct advice. Answer Fosterdogs questions and then you will get the correct answers.
