Another concurrent CEL thread has a specimen letter on it for you to send the solicitors - C-M commented on it last so search her posts. I think it was last night but it may have been this morning. Did you keep the envelope it came in? The other poster did and can show it was date stamped almost 2 weeks after the date on the letter. I think you should add to the letter to make an issue of the fact that the PoC were clearly sent out much later than they (and the covering letter) was dated, ask for the Certificate of Service that has to be filed at court with separate PoC and if you have the envelope enclose a copy and point out the date stamp on it. Ask them why they have filed late, point out that they have no leave to do so and cannot file late PoC without such leave, and accordingly they must apply for relief from sanctions under CPR 3.9. Write to the court enclosing a copy of that letter.


Jonersh has recently commented on this, and I have and CM has. There are specimen letters for you to copy and paste. You need to find all those CEL threads from the last few days and keep on top of them because we are giving useful advice on them which applies to you as well. There is a facility to subscribe to threads: subscribe to these other ones and read them regularly. We just can't repeat the same advice on every CEL thread as there are so many at the moment which are almost identical - I for one can't remember which ones I've commented on and I just don't have the capacity to be going back and forth to check.

If the POC were backdated and you kept the envelope that proved they were not posted when dated, PLEASE NOW forward the complaint you made to the CCBC, to another email address.

Once that has been done, please confirm. We need to bombard the CCBC (specifically to Amanda Beck who is aware of this scam) with evidence about CEL.

Do this - even if you've already emailed a complaint - PLEASE forward it now!

How did this case turn out. Did they drop or did you pay out? There was a lot of help given here.
