tenancy transfer

My son wants to move in with his partner . His daughter has lived with him for 17yrs and housing association refuses to transfer tenancy to her. They say he will be intentionally making her and her 9month baby homeless and they will have to go to a hostel before being rehoused. Can he do anything about this?

  • Good news: Yes: your son evicts his daughter & baby (simple notice, not much time needed). She & baby go down council and make a "homeless application" (no, not fill in form for housing waiting list but a "homeless application").

    She & baby will NOT be intentionally homeless. Council should accept application & rehouse them:

    Bad news: Council rehousing her & baby will probably be either in homeless hostel or homeless B&B or, perhaps, a private let many many miles away.

    Does daughter work? Does she have savings? What is baby's father doing to help mum & baby? What benefits is she getting ? (Presumably at least CB...).

    Who was (ever) named on son's tenancy agreement? When did it start? Which council or housing association, please?

    Or, your son could stay put & keep paying rent and not reside with his partner: (Apologies for stating the obvious but you did ask what he could do).

    Thanks for your reply. My son is only person on tenancy agreement. They have been in current property for 2 years after exchanging from another local housing association that had acquired the councils housing stock (17 yrs in total) The baby's father is not around ( his decision). At the moment my grand daughter is not working and does not have any savings but intends returning to work next year. She currently receives CB Income support and child tax credit.

    She needs to register as an independent person on the housing register.

    She has no right to have the tenancy transferred as she would be bypassing the hundreds on the waiting list who have waited their turn.

    Other option is his takes his daughter with him when he moves.

    Thanks for your reply. Unfortunately his partner's house is too small to accommodate a 21yr old and her baby as she has 3 children of her own. She has been registered on housing list for a few months but the average wait for a suitable property in this area is at least 2 years. So i guess my son will have to wait to move or go down the homeless route.
