Parking Eye query

I'm sorry if the answer is already out there, I have put in a search but come up with nothing relevant but How long a period from entering the car park to leaving the car park are you allowed? We thought it was twenty mins but have had a PCN from Parking Eye for 15mins (no parking space was even used) He has just rang the carpark number and left a message for them to ring back just thought It better if we knew the allocated time if it is 20 minutes. thanks in advance

it is between 1 and say 10 minutes to enter , aprk up and read the signs , plus OVER 10 minutes to leave a car park at the end of the event

the BPA CoP clause #132 is what you need to read

the initial period is not specified but I usually allow up to 10 minutes as the guesstimate

the over 10 minutes to leave is definitely stated

the BPA CoP , essential reading for all

not using a car park space could mean its 10 minutes or less

Thanks RedX, just read it but as you say no times specified, will see what the Car park folks have to say to him and take it from there. There is a baked potato van within the carpark which has a pull in area (no actual parking spaces), usually through within 10 mins but obviously this time longer 15 mins on PCN. thanks for your advice, will update on their reply

best to see what the owners policy is on waiting times for this food outlet

on some car parks they may allow 15 to 30 minutes in short stay bays like for KFC etc - so they should allow longer for food retail outlets compared to the clause #13 allowances for actual car parking

some hospitals allow the 20 minutes drop off , so you might be thinking about those ?

What was the date of the parking event?

What is the ‘Date of Issue’ shown on the NtK?

What date was the NtK received?

Does the back page of the NtK have a paragraph which contains the words, ‘If after 29 days ......’ and further information on the Protection of Freedoms Act 2012.

OK, thanks for your response. Sometimes PE make a hash with their dates which makes overturning the charge very easy. Unfortunately, not so in your case. No worries, we can still help you get rid of this.

First port of call for you is the NEWBIES FAQ sticky, post #1, so please do read that thoroughly as the more you understand this stuff, the better you will deal with it. In post #1 there is a template (in blue text) for you to copy and paste - as is, don’t add, change or remove anything. Send it off to PE by their deadline.

When you get their inevitable rejection, they will send you a POPLA code, then you’re in business and on your way to getting shot of the charge. It’s at POPLA that the Grace Periods will be used to kill this.

Update so far.......he's been in touch with the car park and they told him to scan the PCN and email it to them and they will see if the manager can get it sorted (however the manager isn't available until next week and the issue date was 7/10/17 so cutting it a bit fine if they don't get straight back to him) Also we have found out today that PE is withdrawing from the car park as from Friday 10th November another company will be taking over. I'm thinking maybe he should log an appeal just to cover him? any advice please?

definitely log an appeal before the 28 day deadline to do so

use the blue text template , choose KEEPER on their website and submit it

    do not miss said deadline
  • I actually had Parking Eye cancel a charge for me when I appealed (directly to them, not to POPLA) saying I was driving around and couldn't find a parking space. This was for considerably longer than 15mins.

It was at a hospital where the car park is often full. Maybe they're more lenient at hospitals but it doesn't seem like it from what I've read here!
