As others have alluded, I deliberately didn't address that point as it is absurd to think you can keep the goods AND get a full refund.

Thanks for the feedback everyone. Putting the refund issue to one side though, I am more interested to know when the "contract" should be seen to have started (I have now requested a copy of their T&C's). Is it from when they sent me a receipt for payment (19th September) or when I contacted them and they realised "technical issues" had stopped them registering the order (10th October)?

The contract is "formed" at the point stated in their T&Cs. With most online suppliers the contract is formed upon dispatch of the goods.

If the T&Cs are silent on this then the contract is usually deemed formed on payment.

Impossible to say without knowing the company

It is common for a contact on an internet order to start on dispatch of goods, gives companies to check and cancel if they had made a genuine error. Amazon T&C say ' We only accept your offer, and conclude the contract of sale for a product ordered by you, when we dispatch the product to you'

As the estimated time for delivery is 28 days after dispatch (?) is this a UK company you have ordered from?
