Good morning
Not sure where to post this topic, I filed a money claim online and have now reached the issue warrant stage. I have received a form back which is confusing me a little where could I get some help filling it out please.
I already phoned the Moneyclaim helpline and all they said was we can't give legal advice which was annoying as I was only asking for help filling it out!
I have read the online guidance but no help.
Basically I am entering a warrant against Mr A trading as blahblahbla ltd they have come back and said we are unable to register an individual trading as a LTD company .
So do I delete the Mr A and sue the company or sue Mr A?? HELP

Who is your contract with?
Is there a limited company or just an unincorporated business?
If it is limited company, is MrA a director of the company?
If it is an unincorporated business is it MrA a sole trader or a partnership?0 -
You need to check if blahblahbla is in fact a ltd company. If there is no record (some builders just put ltd at the end of their names as they haven't got a clue) then on the form just put his name.0

to check if the company is an incorporated limited company, search the comapnies house website:
https://beta.companieshouse.gov.uk/
If it is incorporated it will have a company number after the name.
You can also enter an individuals name and see which companies they are a director of.0 -
It is very easy to sue Mr nobody.
This should have been checked before filling in court papers.
If they are a LTD you can not sue a director, you have to sue the company, it is its own legal entity.
If they are a sole Trader, you sue the sole trader of the business .
CCJ,s against LTD companies are as good as useless normally, they are often limited to one £1 share over 2 directors.I do Contracts, all day every day.0
