This might seem like a lengthy post but please take the time to read it...
My partner received a parking fine from Excel Parking Ltd back in 2015. Due to my partner being very stupid at the time he believed because it was an invoice he could dispute this claim and not pay the fine. We then moved into an apartment together (rented) and thought nothing more of this. My partners mum then informed us she was getting letter after letter at her property regarding this fine and insisted my partner should phone about it. Again through his naivety he decided to not do anything about the letters. During this time me and my partner had decided we would start saving for a mortgage and to do this we would move back home with my parents to get the deposit quicker. My partner was then informed by his mum that another letter had come through from BW Legal saying it had been passed onto them by Excel Parking and they would be issuing my partner with a CCJ. We were absolutely mortified, we contacted BW Legal immediately and said how we were saving for a mortgage and this is something that would have a detrimental effect on us buying our first house together. We payed off the debt with BW Legal and were informed both verbally and written that the debt with them was settled and everything was cleared against my partners name. We payed to go to court explained to the judge about how having a CCJ could effect us getting a mortgage and luckily we had the CCJ removed. It was a very expensive process but something we are glad we did and we just put this whole experience down as a lesson learned! I am now living in my new home with my partner, we have a mortgage together and we are really happy.
This is until yesterday my land lady contacted me and informed me there was lots of post still at my old address and she would drop it round. I was baffled by this as I know I have changed all of mine and my partners addresses and I was expecting it to be junk mail. However it was another letter from BW Legal!!!!!!!!!! Saying we owed them another £270.30 from a previous fine in 2014 and because we had failed to pay they have issued another CCJ against my partner. We are absolutely heart broken to say the least. I again phoned BW Legal and they informed us it is our own fault as to why this debt has built up because we did not inform them of our change of address. To which my response was why would I inform them of a change of address when the matter is closed, we have settled the debt in which we owe and I have in writing that we no longer owe this company any money!!!!!!!!!!!!! Their response was this is a separate case with a separate ref.no and had we at the time of the first ever letters/phone calls asked them to check if we have any more debt under a different ref.no they could have checked this for us. However because we didn't ask they are not obliged to say. So they have been sending all the correspondence to my old address and due to this the debt again has racked up and because they have not received payment another CCJ has been issued.
I cannot believe after everything we went through the first time this has happened to us again, I am absolutely disgusted. Excel Parking are crooks and looking at google and their reviews only proves all the more what type of company they are.
Me and my partner are good people, we have good jobs and have never been in any form of debt. We pay our mortgage on time and all of our bills. This is just another thing hanging over our heads, we are a young couple who work hard for what we have. We are wanting to start a family soon and something like this has just knocked me for six. I'll feel scared to open any letters in the future now for fear it is them coming back for more money.
The payment in which we owe them may only be £270 but it's the principal of the situation and how they can still come crawling out of the wood work demanding money. I have tried to contact the courts and they won't even look into my appeal without paying the £250 court fees. This CCJ is going to be against my partners name for another 6 years now as we cannot afford to pay another court fee to try and have this removed.
I am phoning BW Legal tonight to pay the debt balance again in full and am hoping this is the end of our hassle with them- forever! Please everyone that reads this tell your friends and family, these people need to be exposed for the crooks that they are and if by doing so it stops this happening to any other family or young couple then I have done something right! How pathetic and passive aggressive.
Thought I was being helpful but I've clearly made a massive error in doing so.
