3yr rule issue

Hi.
I have a question that I can't find an answer to anywhere on the forums. I sent off a PPI claim to the Bank of Scotland a little before the 3 yr time limit (They'd sent me a letter to notify my back in '14). Whilst sending some other claims off I realised I hadn't heard back from BoS so sent of another claim form (they'd sent me 2 back in '14). I got a rely saying they were investigating, then another today saying that they were rejecting my claim as it was outwit the 3yr period. I'd sent the first form away within the 3 years though. Do I have a case for the FOS?

When you didn't hear from BoS after you sent the first form did you query this with them at all or did you just send the 2nd claim form without out any reference to having sent the first form within 3 year time limit previously with no reply.0

I didn't question the first form. To be honest once I'd sent the first form it went out of my mind until chasing some other PPI claims. I then looked back at my files and found the second letter they sent me so sent that off. They replied to that one as its conveniently dated after the 3 yr period.0

Put your case re timescales to BoS and if no joy try FOS (don't wait too long though you must contact FOS within 6 months). At the end of the day unless you've got any evidence re the first form being sent within the 3 year timescale it'll just be your word against BoS.0
