Pip mobility - moving around

Hi

I recently received my PIP decision where I was awarded 10 points for moving around more than 20 metres but no more than 50 metres.

I have asked for a mandatory reconsideration and am forwarded another couple of pieces of information.

I am contesting this as every day I can't walk more than 20 metres for 80% of the time. I am only able to leave the house for a couple of hours in the afternoon if well enough.

Every morning I have trouble descending the stairs due to pain and stiffness in my hips and if I do manage to go out in the afternoon I can't leave the house the next day due to extreme pain and fatigue. I also never leave the house in the evening as my pain intensifies.

Am I reasonable to think that I should have been awarded 12 points for this activity based on not being able to stand and move for more than 20 metres?

  • Just thought I would mention that occasionally, say once a fortnight I can walk quite a bit further than 20 - 50 metres.

    Would this disqualify me from being awarded the higher rate of mobility?
  • I'm just trying to ascertain that I am doing the right thing asking for a mandatory reconsideration on this mobility issue?

    As you've already asked, it's a little late now to change your mind. PIP is also about the reliability criteria. If you can't do something regularly, reliably, without pain and discomfort you're classed as not being able to do it. Although you can't just choose which part to ask for the MR in because they'll look at the whole award again. You do risk losing everything you already have but also there's a 20% chance you'll have your award increased and an 80% chance your award will remain the same. Good luck.

    A descriptor applies if the impact of a health condition or impairment is experienced on the majority of the days over a 12 month period. So being able to walk further than 50 meters one a fortnight should have no effect on your claim
    You should also get the points for the descriptor if you can't complete an activity or need support to complete an activity at any point of the day. this is then classed as being the whole day.
    But they don't always abide to the guidelines good luck

    I'm taking it to court for very similar reasons. The mandatory reconsideration came back with no changes despite more evidence from my MS nurse being sent in.
    I've been waiting 16 weeks so far for a hearing date.... Apparently there's an average 20 week wait in my area now

    I just want to point out for anyone else reading this that 'taking it to court' is a bit of an alarmist way of phrasing it. A tribunal is informal and friendly to the claimant. It's not like a court case on TV with a judge and lawyers.

    I just don't want anyone being put off doing a full appeal because they get the wrong impression.
    Unless I say otherwise 'you' means the general you not you specifically.

    I'm in the same situation I got 10 points for each went to MR and cheekily they gave me 1 extra point so 11 and 10 even though sent more evidence from my Dr. so still in the standard award. taking it to tribunal been waiting since the end of July.
