Money deducted from deposit for parking permit by landlord

Hi there,
We have recently moved out of an apartment we rented for 12 months.
We handed the keys over at the same time as he inspected the property and he said everything was fine and we signed the forms.
Now two weeks later we still haven't had our deposit back, he says he will sort it out when he gets chance. Hes also now saying we didnt return the parking owemit (peice of paper) and is charging is £50 out oir deposit to replace it. However this is 2 weeks after, we threw it away as we didnt realise, he never asked and its not in the AST we were given.
Is there anything we can do to contest this?

Raise a dispute with the DPS.
You should have details of the scheme your deposit is registerd with

I shall ask him, do we have a case to dispute the charge for the permit?
As in the OP, we handed all the keys and he did his inspection and everything was fine. Its only now two weeks later we have asked why we havnt had the deposit yet that hes mentioned the permit, we just threw it away as it wasnt mentioned and we obviously disnt need it anymore.0 -
You dispute the whole deposit with the deposit scheme.
They are refusing to release it without you agreeing to a deduction.
You need to put a stop on the landlord getting their hands on it.I do Contracts, all day every day.0 -
Any permit should be on the inventory along with the amount of keys or find you were given.
They need to prove it for deductions not you.0 -
I don't think it's as obvious a case as some are suggesting.
* how did you get the parking permit? From the LL? From the building's management company?
* What were the terms & conditions of the PP? Did you make any payment for it? Was it provided free? Did you pay a deposit for it? Did you sign anything (eg a receipt) when you received it, perhaps undertaking to return it when you left?
* Was it mentioned in the tenancy agreement and/or inventory? What exactly was written?
It seems logical/fair to me that assuming the PP has some value (ie unexpired period of free parking or a replacement cost etc), and you threw it away rather than return it, then you've caused a loss to the LL which he should be able to reclaim.
Of course the above assumes
* that you have caused a loss, and
* (morality aside) that the LL can prove you've caused a loss0 -
Does your tenancy agreement mention the parking permit and returning it?

Surely the loss of a parking permit relies on more than just a piece of paper? Or is it a case that whoever issues that permit will charge £50 just to re-issue it (which in itself seems outrageous, but if that's the cost to the LL than it is fair enough it should be passed on).0
