there isnt one
but for England and Wales there is a maximum limit of 6 years from the initial event to isue an MCOL (5 years for court claims in Scotland)0 -
I'm asking because I was issued an LBA in June which I responded to but no court papers have arrived yet. Others I know who also got scammed by the same PPC at the same site received their LBA after me and have already received court papers?0 -
all up to the PPC to issue the MCOL or their solicitors to do so within the 6 years statute and its been that way since 1973 when the small claims court was introduced
it is what it is , 6 years for court proceedings following an unpaid invoice being issued , for parking , new boiler , new roof , whatever0 -
Thanks Redx. Just seems unfair that I won't know when this nightmare is over for 6 years!0 -
agreed, its what we all think , which is why we warn people to strap in for the long haul0

Which parking company? The likes of CEL have a habit of sending out an LBA. Then, instead of issuing court papers, they send the alleged debt on another round of debt collectors in order to inflate the costs, and issue a new, much bigger LBA some time later. It's therefore important to keep that LBA, as you'd use it later to question the antics of the PPC if they behave as described.0
