  • So Britannia have submitted their evidence, looks like in my haste and frustration I let slip who the driver was in my first appeal to them :( But the rest of their evidence consists of some badly taken photos / badly scanned documents and this statement:

    This car park uses Automatic Number Plate Recognition (ANPR). The car park is not manned.
    No transactions for this registration were entered into the machine whilst the vehicle was in the car park between 14:16pm – 14:38pm. No payment attempt has been made at the machine, pay by phone or to us by phone after the vehicle left. I have attached the machine data to show no attempt was made to purchase a ticket whilst the vehicle was in the car park. It is solely the drivers responsibility to ensure they have read the terms and conditions of the tariff board. The machine data is attached to show the machines were working and processing at the time the vehicle was in the car park.
    Additionally we allow up to 48 hours after the driver has left the car park to call to make a late payment should the driver contact us .
    Users are able to obtain 30 minutes parking for free at this site, provided a registration entry is made to allocate the time to the vehicle. The signage clearly states a ticket is required for 30 minutes of free parking.
    The data from the machines is processed against the pictures recorded from the ANPR camera and as no registration matching the vehicle had been entered in the machine the system generated a Parking Charge Notice. The ANPR camera only takes a picture on entry and on exit this is not a CCTV system.
    The driver has broken the terms and conditions by failing to purchase a valid ticket and therefore we believe the Parking Charge Notice to be valid and correctly issued.
    We uploaded the Parking Charge Notice data on 26/08/2017 and requested DVLA Keeper details on 30/08/2017. Keeper details were added to the Parking Charge Notice on 31/08/2017 and a letter was then generated and posted on 01/09/2017.
    We first received an appeal on 06/09/2017 from the driver of the vehicle. The appeal case was investigated to see why a Parking Charge Notice was generated. We responded on 06/10/2017, advising it was issued correctly.
    We have identified the appellant to be the driver and keeper of the vehicle, as they have selected “driver” when submitting their appeal to Britannia Parking and therefore we find them to be liable for the parking charge notice.

  • I actually don't even remember the boxes, however in the first appeal they have quoted me saying: "I entered the car park at 14:16 and left at 14:38, a total of 22 minutes."
