    I've seen one of their new Letters Before Claim, dated after 1 October.

    They have changed the wording from their previous version. It refers to the new PAP, and provides a link to their website where the defendant can log in, create an account, and download the Reply Form, and Financial Statement Form online.

    This is not strictly in accordance with 3.1(c) and (d) of the PAP, which say that these forms must be enclosed, but I would imagine that most Judges would rule that they have complied with the spirit, if not the letter, of the rules.

    For the vast majority of recipients of this letter, responding online will not be a problem, but for some wrinklies who don’t have access to the internet, or lack basic skills in that respect, they are disadvantaged by the fact that no paper forms have been sent.

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx.     You underestimate the fact that nowadays, many many people
    are wary of any site that requires details being entered and
    this is because there is a prospect of a data breach and scam.
    Gladstones have not proven otherwise.
    They have a trust factor of ZERO and that is a good reason
    to demand that they comply to the new rules and not hide
    behind an internet page
  • Couldn't give a monkey's about the proforma reply form (which you don't need to reply on anyway).

    What it IS important that they comply with is the request for the contracts within 30 days...

    Why bother setting up a bogus email addy ????

    Simply say no to anything online regarding a claim from a solicitor
    due to the mistrust of the internet as highlighted weekly
    Unless a judge knows differently ????

    Request the full claim is sent by post to the keepers address

    Gladstones and any other solicitor are legally obliged to comply
    to the new procedure. The new procedure does not require the
    defendent to open an online account with the claimant

    I have a bet on with a friend that Gladstones will be the first
    to ignore/break the new rules. My friend says it will be BWLegal

    Won't be long !!!

    As a wrinkly myself, but with a modicum of skill internetwise, I thoroughly dislike conducting business on line. Today for instance, I tried to renew my BB online. Three times my postcode was rejecsted, then I had problems moving to the next page so tomorrow will ask them to send me a paper form.


    On line banking is a nightmare, especially as The Memsahib has opened two more acconts and a rewrds acconunt, and eBay is so slow.
    You never know how far you can go until you go too far.

    All ages suffer this problem on the net, hence the
    Gladstones wheeze should be ignored .... yet again ?

    I rather think that BP when referring to wrinklies and those
    not knowing what they are doing was actually talking
    about Theresa May and Corbyn, one without a clue and the
    other living in the clouds
