ha! Secretly toad man in disguise! In the fact that I now have to buy a new card. and they are 650 for a like for like replacement.
Which are are we talking about the most expensive on can find on line is £600

A full refund is more than you would get from a retailer who would make a deduction for the use you had from it.0 -
I do understand your point about replacement cards now costing significantly more, and that you simply want a like for like replacement....
However, I also think the manufacturer has put forward a very reasonable offer. You have had more than a year's usage from the card and now they are offering all your money back.
Short of pleading to the manufacturer, I don't think you are going to achieve anything more.
If you tried to go down the retailer / legal route, not only will you have the hassle, but ultimately a retailer / judge will only award the value of the card - most likely less an amount for the use you've already had! Let's say such a card should last five years, then you would get £320 back.
Sometimes it is best to accept the offer on the table and move on. The company has offered to refund all your money, you've actually had a year's use out of the card, and the likelihood is that you will have an even poorer (albeit legally fair) offer from the retailer / court if you tried bring a claim.0 -

I have gone to them as a manufacturer. I get what everyone is saying. But surely the years usage is irrelevant as the item has a 'LIFETIME WARRANTY'
Lastly, If I accept their offer, should they be refunding the VAT? as the price was 400 ex VAT

Have you read the terms of the Lexar Lifetime Warranty?Your exclusive remedy and Seller’s entire liability under this warranty will be for Seller at its option to repair, replace, or refund the Product that is determined by Seller to be defective during the applicable warranty period. A refund would be the purchase price less any rebates or the fair market value, whichever is lower.
How much did you pay the retailer for the item? Was this a business purchase?
