Builder trying to change house 1 year later

    Going on how you've shouted at some of us here, I'm not sure how such a meeting might go, but your neighbour's first reaction won't necessarily be her final position on this. Like you, she'll probably need a little time to take the situation on board, so give her that and don't push for instant agreement.

    I've not shouted, I was just trying to get answers to the questions that were worrying me instead of people just saying 'just get it done'

    My primary concern here is selling my house, I can't afford to jeopardise this as I'm a single parent who can barely afford the mortgage!

    I will speak to the builder tomorrow and see what they say. If I have to get neighbours consent I'll try talking to her. She does seem adamant she doesn't want this!

    So what happens if the homeowner changes the railings back to a fence at a latter date?.

    I think that is your answer.

    If the boundary is yours no problem the neighbour can't stop it as it is nothing to do with them.

    If the boundary belongs to the neighbour then I can't see how this will effect the sale of your house as it is nothing to do with you house.

    As long as your house confirms with the planning permissions required of it your are fine.

    If the planning authority notice it, they'll enforce again.

    It's possible to apply for retrospective planning consent for what is there, the planning office will tell the OP what the likliehood of being approved is. My guess is that it wouldn't, or there wouldn't be so much effort now to replace something opaque with something you can see through.

    Has no one told the OP exactly how it contravenes planning? I'm guessing it's the height.

    How tall is the existing fence? I believe you can erect a fence up to two metres without planning permission
  • So from ground level to top of fence it's approx 10ft! Half of that is the wall (fence is on top). So, very high!!!
  • 10ft high! . . . that sounds like the problem.
