CEL - Claim Form Recieved Looking for some help please

Hi all
I have done some backround reading and understand the process how to move forward but looking for some advice and support on my defense.
I have recieved a claim through from Civil Enformcement Ltd. Please see details below
Orginal date - 08/08/15
Amount - £236.00
Claim issue date - 03 Oct 2017
Background -
I remember a while ago getting the claim form. But as I was unaware and it provided no details of which carpark I ignored it. Since then I have moved to two different adresses so I have not recived any more corrspondense ( the original adress is a family members house) . I have now been forwarded the the county court claim.
I am still unaware of which car park it was or time or any specifics for that matter. I was defintley unaware of any carpark restirctions at the time and not even sure it was my self in the car.
I have start the AOS protocol to apply for the further 28 days, and looking to start putting together my defense.
Any support would be very much appreciated.

you have done ok so far
read post #2 of the NEWBIES sticky thread and start looking at the 2 stock CEL defences in there plus another dozen or so over the last few months (nothing older)
then draft your defence and post it on here for critique
bacuse its a claim from this month , they should have complied with the new protocols from 01 oct 2017 , which means they should disclose full details to you
if they havent, this will be a part of your defence0 -
Copied from a wrongly posted seperate thread
Fristly big thank you for all of the information and contect on these threads it is has been pricless knowing there is a way of defending and other people are going throught the same process.
So I posted back when I first got my service of a small claim. Please see orginal thread -
(Your acknowledgment of service was received on 16/10/2017)
I have been waiting since then for CEL to send me the Particular of Claim. I still have nothing throught to either my old address or my new current one.
Should my next course of action be to draft a letter to CEL and the coursts informing them I have not recived anything. Time is marching on and I have not been able to put together a defence as of yet.
again thanks for any information0 -
Your OP says claim issued on 3/10/17 AND you did an AOS to gain a further 28 days??
If that is correct (ie you did an AOS) then that gets you just 14 days extra - 28 in all!
Please confirm if you did or did not do the AOS0 -
Hi Qientin
I did do the AOS yes 28 days in all0 -
Read up on this issue with CEL (all covered in the newbies faq)
(You cannot send in a full defence without getting the POC! See suggestions in the threads linked to in the faq)0 -
Sp[ecifically CPR15.4 states your time to submit a defence does not start UNTIL the POC are served on you
The CCBC are too dense to understand this, however the rules are clear.
The period for filing a defence
15.4
(1) The general rule is that the period for filing a defence is –
(a) 14 days after service of the particulars of claim; or
(b) if the defendant files an acknowledgment of service under Part 10, 28 days after service of the particulars of claim.
(Rule 7.4 provides for the particulars of claim to be contained in or served with the claim form or served within 14 days of service of the claim form)0
