    Just coming on to say thank you again for your detailed advice.

    I have been doing what you told me to do this week and I will give you the full details later today, if that's okay.

    I have had the ESA Appeal accepted and letter received from HMCTS.

    They are spot on in this area and amazing how they receive paperwork and copy back sometimes in less than 48hrs or maybe the same everywhere.

    I think you need to form your own Chargeable Advice Website.😆

    It's brilliant how you listen to strangers problems and take the time to work out their dates precisely.

    I still have had no payment from either ~ now 8 weeksfir ESA.

    I contacted the PIP office at DWP via the freephone number because I had no credit and the London Atos very willingly transfer you the PIP office if you ask, I don't know if everyone knows that.

    When I was transferred to DWP PIP office, they said I've got to wait in the que and it does not matter if you have waited nearly 2 years, how they can't put a note on my file to hurry it up, advising me to get my MP involved, just not interested as normal for me.

    I asked for a call back and he allowed it, which was literally 15 mins later.

    It was from a clerical worker not a DM, who was so sympathetic I thought it was a joke and he said he would pass it on to the DM that I had waited so long, don't know if it will make any difference.

    Regarding my, ESA claim I sent the SSCS1 to the Tribunal on Monday.

    I know HMTCS are very efficient so on Wednesday 11 October I sent my old medical certificate from when my ESA claim was stopped and put a letter in asking for 'Assessment Rate' please as I had taken my claim to Appeal at Tribunal.

    I had not received a reply from the courts but I knew they would be by end of week and by the time ESA got the letter from me it would meet up with the court letter accepting my appeal for ESA.

    On Friday 13 October just gone I received the court letter from HMCTS accepting my Appeal.

    I contacted ESA who said we have received medical certificate with your letter but have not received their letter from the court yet.

    She double checked, was very helpful, then she asked for the reference number and she would send to the 'Appeals Section'.

    I don't know if DWP have a computer link with HMCTS, were just taking the ref number just to match up with their copy when they receive it/comes through or what, I can't imagine them phoning HMCTS to confirm, do you think?

    I sent another letter on Friday with reference number (no copy HMCTS letter), which they will have received Sat morn or definitely this morning.

    Whilst I was on to ESA on Fri afternoon I thought I should ask about my Complaint which has been lodged with ESA since February, I have had a few responses even fron Acting Head of ESA Operations, but still not resolved.

    So I have done everything, I think but still in limbo.

    The appeals when received at ESA, I believe by email, are then put onto the ESA Decision Makers Appeals computer system called DMACR.

    She should have looked in DMACR, maybe she did.

    One way around this, is to ask for a jobcentre appointment to have your appeal letter and duplicate of your letter requesting re-instatement on appeal...scanned to ESA, it then gets actioned that way.

    Don't for get to ask them to do an eIS10 with you over the phone, to be sent in a handover.

    From what you say, the PIP has been decided already. If so, it will already be on DWP systems (C.I.S.)

    The eIS10 is a form they do over the phone, you do it, then they handover the completed from to the ESA Benefit Centre

    If you want to be sure, phone PIP first and ask them has your PIP been put onto C.I.S. yet? Customer Informations System.

    When you know it is on CIS then you can do an eIS10 with ESA over the phone.
  • Good afternoon to all the helpful advisors, Epitome, Alice Holt and all.

    I have finally had the ESA Assessment rate reinstated, ater 3 letters delivered by hand to the local Jobcentre (not scanned)....and 3 telephone calls to ESA office totallin 110 minutes including waiting time.

    I have today received 2 letters advising:

    You are not entitled to ESA from 22 Aug 2017 (this is when my claim closed after a 0 point WCA).

    I am not entitled because not enough NI contributions or credits Years ending 2013 and 2014.

    You are not getting an income related amount because:

    We have used tax years ending 2013?and 2014 to assess your claim..

    To continue to receive ESA you may need to attend a WFI, you will be notified separately.

    It has been confirmed you have limited capability for work. The extra money you will get is shown(no ESA Award page with the his letter) on the ESA Award page. ??????

    The second letter, same date states You have appealed against a decision that you do not have a LCW.

    We wll pay you at assessment rate until your appeal is heard.

    So I am even more confused now.

    I have not had one single letter from PIP and yesterday when I phoned, they said the 28 days since my PIP Appeal is up so he didn't think they were taking to UT.

    I understood it was a further 28 days, after receiving SOR that they could appeal?

    Does anyone understand this please ir have you been through the same, maybe?

    The first letter ( I think) seems to imply that you will move from contributions-based ESA to income-based ESA.
    So the DWP will assess your income and capital to check you are eligible for income-based ESA (usually a ESA1 form).
    But the bit about "You are not getting an income related amount because:
    We have used tax years ending 2013?and 2014 to assess your claim...."

    Seems complete nonsense!
    As does:
    "It has been confirmed you have limited capability for work." - when you appealing?
    Double dutch has nothing on DWP letters!


    The second letter is good news - I would expect ESA payments to resume at £73 pw.
    You will need to supply "fit notes" pending the appeal.

    Epitome may well be able to help guide you on what to ask when you ring DWP to clarify this.
    He is much more expert on the DWP call-handling processes and screens.

    It may be worth sending a copy of both letters to your MP and asking them to intervene and get you an explanation in plain English from the DWP. Unless your MP can explain it (which I very much doubt)!

    Re PIP: I think - had the DWP requested a S of R you would have had a copy or been notified from the TS. So the PIP man may have that right.
    Just keep phoning them, and see if you can get it expedited asap. I understand there is a bit of a backlog.

    I have been on Income Related ESA from the start, so I don't understand what they mean at all but I am absolutely grateful they have reinstated it.

    I phoned the PIP office at 16:40 tonight and they advise the DM has reported my claim to 'Banking' because the system will not let her make the payment!

    Thank you once again Alice, because if you and Epitome never advised me to get my SSCS1 form sent off I would not have had the ESA assessment rate reinstated, which I desperately need and am so grateful for.

    Hi,
    Ignore the first letter, who knows why it was issued, but it was issued when someone was inside your records and changing and updating stuff, in the process of getting you onto appeal rate, who knows what incorrect options they put or were trying to clear, they really should not have allowed that letter to go out, but if they don't notice the claim is messed up when they press 'END' the letter goes out over night and they can't stop the letter from going out once 'END' has been pressed.

    What they then did, was to realise your claim was not right, fixed it, and then pressed 'END' again so the correct letter went out...your 2nd letter that tells you are to be paid on appeal.

    When PIP confirms that PIP is now awarded and is showing in C.I.S. you can ask ESA to do an eIS10 with you over the phone... you need one eIS10 for each address you lived at since your PIP "awarded from" date.
