Hello, I have now received a Questionnaire (Form N180) to complete. I intend to challenge CEL. Do I scan and send the form via email or shall I post?
Also, any advice what to include on the following:
Section C (Do you agree that the small claims track is the appropriate for this case? Yes or No? What option do I go for?
Also, am I right in thinking I tick 'No' for asking the court's permission to use written evidence of an experrt?

Hello,
I have now received a general form of judgement or order form fom my local court.
Am I right in thinking, at this stage, I as defendant, do not need to do anything.
The letter states it is ordered that the Claimant (CEL) file at court and serve me a further POC by 18 Dec 2017 by 4pm. It also states that the CEL need to set out by reference what is admitted, what is disputed and why. The deadline for this is 4pm 4 January 2018.
Any advice re what I need to be doing at this stage would be much appreciated.

That's good - have a relaxing Christmas break, basically. The ball is in CEL's court and they ARE likely to send something, so don't be upset when they do, last minute!
Then you can show us their rubbish and work out your amended defence if needed, in response.

Can I just check that the above court instruction is directed at CEL and not you as defendant. Why would the claimant (CEL) provide any ‘admission’ or ‘what is disputed’ - they’re not disputing anything, surely it’s the defendant who will be disputing.It also states that the CEL need to set out by reference what is admitted, what is disputed and why. I’m no expert in this, but where I’ve read cases where new PoC from a claimant are required by a certain date, the defendant has the opportunity to dispute with a deadline a couple of weeks later.
I don’t mean to set hares running, but please do check exactly what the court directions say.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Thanks Coupon-mad for your reply, it is reassuring to hear CEL are discontinuing before hearings. My letter does state "because this order has been made without hearing, the parties have the right to apply to have the order set aside, varied or stayed." I'm not doing nothing.
Umkomaas - thanks for your reply too. You are right, it is the defendant that needs to set out by reference to the further POC (which has not been received as of yet) what is admitted, disputed and why. Sorry my mistake!
So, am I right in thinking, that I need to contact the court just after the deadline the court has set (18 Dec 2017 by 4pm) for the claimant and if they have filed something at court and, I've received the POC, I respond by the date the court has given me, which is 04 Jan 2018.

You also need to have received the new PoC, otherwise you cant respond!
IF they get you sometihng on time - not one day late, ON TIME - then you amend your defence by
1) crossing through any deletions
2) making clear any new additions, I think you could do this in red?0 -
