Legal advice post-separation

  • i have had a property empty for a few years i have seen it on auction sites smd it was solf earlier this year I went to the property and someone was living in the house..
    i have no mortgage the house was paid for
    the only possible debt would be for unpaid council tax

    no one has made any attempt to contact me.
    can this be done
    is it legal.
    and is there anything i can do.
    it looks like it was sold for about 2 thrids to 3 quarters below the average selling prices of houses on same street

  • I am in the same situation, long story I am ex army and was admitted into hospital voluntary suffering from depression and anxiety. We both own our house with only £16k left on the mortgage, house is valued at £310k. Before I was discharged from hospital my wife left me with our 7 year old son and is now staying at her dad's with me living in the family home. I have accepted our 22 year marriage is over and I have suggested to my ex to buy me out or sell the family home and split the proceeds 60/40 in her favour. She cant buy me out, but has said that she wants a divorce first then sell the house, I have made legal enquiries and found out that costs can be upto £8k per party, double that if it goes to a third hearing. My suggestion was for her to buy me out or sell on the open market 60/40 in her favour and then the divorce so costs will be a fraction already quoted. She has refused to budge. I would like to release some equity on the house to enable me to move on but I am only 49. Any advice will be greatly appreciated.

    On what grounds would you divorce? Separation is at least 2 years.


    You can force a sale if you want, but that's £10,000 roughly.
