    unless you get put into the support group then your ESA entitlement will have run out after 365 days.
    any future payment will depend on being placed into the support group.

    you need to look at the descriptors to see if it is applicable and then gather evidence to support your claim

    I was in the work related activities group and wouldn't expect that to change, there's no way my condition is stable enough to qualify for the support group. But before the work capability decision was made I was being advised by DWP to apply for ESA(IR) due to the 365 day limit approaching, which surely implies that it's available to people in the WRAG?
  • Sorry if I am typing in the wrong place but I am new and couldn't see where to start a new thread.
    I haven't worked since 1996. When I left work I signed onto JSA contributory. I became very sick in 1997 and received Incapacity benefit (contributory) and was then migrated to ESA (contributory -support group -so have income related top-up for enhancement disability). I have an esa assessment this Wednesday and if I fail I intend to go for mandatory reconsideration followed by the courts if necessary. I am trying to avoid signing on for universal credit as I wouldn't be able to go back to esa pending appeal so would be stuck on UC. My question is am I eligible for new style JSA? (as I have always had contributory benefits once after the other?) Or would I have had to have worked for the last two years? Please help! Thanks in advance.

    1) Go to the front page listing the Benefits & Tax Credits threads and click on the red button which says "New Thread"

    2) You won't be able to claim New style JSA. You need to have worked and paid NIC in the last 2 tax years.

    3) You will be able to have ESA resumed pending appeal (after the SSCS1 form has been lodged, but not at MR stage). Why do you think you wouldn't?

  • Hi Alice. Because apparently the rules state that if you are in a full service UC area and you start a new claim, it has to be for UC because I am in UC area. And once you are on UC you cannot go back to the old legacy benefit (esa) even if it is pending appeal, you have to stay on universal credit and sign on and still follow claimant commitment etc. Regarding the new style JSA, I don't understand how all of my benefits that I have received since stopping work have all been contributory benefits if I haven't worked the two previous years? (Not worked since 1996 yet was put on contributory ESA just couple years ago)??
