Barnet Hospital - Parking Eye

Hello all,

Another Parking Eye at Barnet Hospital ticket here. I care for someone and was taking them for a blood test at the blood test unit attached to the hospital. Having dropped them off I circled the car park and it appears I entered the staff parking area which is ANPR controlled. I did not park in a space but sat for 10-15 mins while I waited to pick up my patient. The notice says I was in the restricted area for less than 20 mins but only shows entry/exit and is a charge for 'parking' which obviously doesn't apply to my stay.

I went back in and spoke to PALS at reception after reading through here first but they said they were unable to overturn tickets and to appeal to PE. They did mention a 20 min grace period though so I would be okay if true.

I have the BPA appeal template but should I appeal to the landowner first ?

I'm hoping this is the correct BPA template -

I challenge this 'PCN' as keeper of the car.

I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs were not seen by the driver, are in very small print and the terms are not readable to drivers.

There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.

Should you obtain the registered keeper's data from the DVLA without reasonable cause, please take this as formal notice that I reserve the right to sue your company and the landowner/principal, for a sum not less than £250 for any Data Protection Act breach. Your aggressive business practice and unwarranted threat of court for the ordinary matter of a driver using my car without causing any obstruction nor offence, has caused significant distress to me.

I do not give you consent to process data relating to me or this vehicle. I deny liability for any sum at all and you must consider this letter a Section 10 Notice under the DPA. You are required to respond within 21 days. I have kept proof of submission of this appeal and look forward to your reply.

I've read through as much as I was able to regarding the appeal process but hope to get some confirmation as to the first body to appeal to.

    deffo appeal to landowner first, but make sure your PE appeal goes in as KEEPER before the expiry of 28 days you are allowed to appeal within

    So the landowner would be the NHS trust, and just appeal to both at same time to keep the PE 28 day deadline ?

    Also would supporting documents showing appt date/time help to prove the reason for visit ?

    Yes it would, but Parking Eye won't be in the slightest bit interested in that.
