Now it is important to note that SDP arrears are classed as official error.

Official error arrears of £5000 or more are disregarded for the life of your ESA claim, or also disregarded for a JSA claim made I believe within 1 year from now.

It is the claimants responsibility to be able to prove that the savings are official error for any future dispute.

In that regard I bet you have not been given a letter from ESA or from IS saying what the amount is and that it is official error.

My advice to you therfore is .... phone ESA and phone IS and ask each for a letter confirming the amount paid to you and that it is classed as "Official Error Underpayment"
  • you are correct epitome, I have had no letter, the money just went into my bank,I had no idea I even had it.I rang up yesterday to see what was happening and the lady on the phone told me that it had been paid.
