    Court Claim was dated 22nd June so I need to get my defence in this week.

    Have you looked at how other defences are laid out?
    THey have all para numbered, for a start. ALL of them.

    You can make any request you like. Noone will properly look at it, or entertain a request, unless you pay £100

    If the Issue Date on your Claim Form is 22nd June, and you have done the AoS in a timely manner, then you have until 4pm on Wednesday 25 July 2018 to file your Defence.

    Over a week. Plenty of time.

    When you are happy with the content, your Defence should be filed via email as described here:

    1) print your Defence
    2) sign it
    3) scan the signed document back in and save it as a pdf.
    4) send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    5) just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.

    My original defence is numbered but for some reason it changed to bullet points when I pasted it into here.

    Leave that aside. I can't find the reference to it so is there a thread number

    As regards your defence, if you are happy with it, get it sent. You could be here for ever but it covers the bases which are

    1. The parties
    2. The signs
    3. The authority
    4. The amount and justification for it.

    These are 5 minute jobs at a court so help the judge by keeping the issues narrow (as you and the claimant are supposed to)

    Unless you file an Application with the court and pay the £100, to be heard on papers, noone will look at your defence properly until the hearing date or just before.

    Thats what I meant
    You can state anything in a defence and noone cares a fig. You can literally type in "this is not my defence", and they will take it as your defence!

  • I have been waiting for the Notice of Allocation from my local court but yesterday received a 'General Form of Judgement or Order' form, which says:


    IT IS ORDERED THAT


    The Claimant shall file and serve a Reply to the Defence by 4pm on 10/10/2018.
    Pursuant to CPR 3.3(4) this Order has been made without a hearing being held. If you object to the order, you may make an application to have it set aside, varied or stayed within seven days of receiving it.


    Is this normal/good/bad?


    Advice regarding what to do next would be appreciated.

    Sounds good, like a clued-up Judge has decided the C hasn't convinced him/her that they have a case against your defence (Skipton or Manchester Court, by any chance?).
