Smart Parking Ltd, Newquay

Hello everyone,

I'm also hoping for some advise on a parking notice please.

I received a Charge Notice for £60 from Smart Parking with photos of my car entering and exiting the Fistral beach car park. The Parking Charge is from April. The parking was paid for.

I have also previously received 4 letter from Debt Recovery Plus, and two from Zenith collections.

Yesterday I received a letter from Gladstones solicitors saying they have been instructed in relation to the debt, which is now £160. I have now read the Newbies section, and see that I should have appealed rather than ignore them, which was the advice I read elsewhere.

I see on www bmpa.eu that only a small number of cases reach the court. I am still tempted just to leave it, but if I decide to pay now, instead of risking the trouble of going to court, can I just pay the £60, or should I settle the whole new amount?

It's such a pain having them pester you, and I hate to see them getting away with this!

chances are the letter is from DRP and the ref starts with a 3 (so not from Gladrags as their ref starts with a 1)

the fact it says GLADRAGS on it means nothing , see who it says to contact or pay

    DRP ? or GLADRAGS

if its DRP sc@mming you WITH PIMPED OUT LETTERHEADS from Gladrags

    IGNORE

and no you cannot just pay what you like , only IN FULL or a negotiated settlement

as this overstay was say 13 minutes, its well within the BPA CoP guidelines so you should win in court anyway

They might accept a lower offer, but unlikely! (Once you start making offers they will see you as someone not up for the fight)

This forum is for fighting not capitulating

If you intend fighting then edit your post to remove details of who was driving

Then read up on gladstones - is this a proper LBCCA or just a debt collecting effort?
  • Thanks Redx,

It does start with a 3 yes, and it says to pay the agent - DRP.

    I will ignore :)

so no different then the DRP letters and Zenith letters, all from the same sc@mmers

the BMPA site has advice on drp letters too , including scans of the various incarnations etc

Gladrags know nothing about it , so by reading the letterhead you have been misled
  • Thanks Quentin. I've made a few edits just in case. I'll check out Gladstones too. I hope it's just a debt collection effort.
  • Sc@mmers indeed Redx!

Indeed it is, but you might get a real version at some point. Be ready for what they now have to do, and to pick them up on it, when they don't:

We do win over 99% of defended cases here, if push comes to shove, defend with our help!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
