I'll try keep this as short as possible, sorry for the story:
There is a car park in my local town that had been free to park in until Excel bought it recently. So when the date the parking charge was given, this was my first time using the car park since it had been bought.
When I go to pay at the machine, two women were in front of me queuing - they both then left realising they did not know their registration numbers. I hadnt used this machine before so I put my money into the machine and started entering my reg number - I noticed that it wasnt appearing on screen but figured that my reg was still being recorded. I printed the ticket and noticed that the letter 'R' had been printed where the reg number was supposed to appear- the first woman in the queue had begun to enter her reg number before leaving the machine.
Unsure of how the car park operated I placed my ticket on the dashboard of my car, hoping that an attendant would see the ticket and that I had paid (I didn't know that this car park had no attendants).
When I returned home I called the helpline of the company as I was worried about recieving a parking charge - the gentleman on the phone asked me for my registration number and assured me he would take care of the issue for me.
Of course I still recieved a PCN - I had kept my parking ticket just in case and appealed the charge as I felt the charge was unfair. My appeal was dismissed and I then made a further appeal through the IAS as directed. I received an email this morning to say that my second appeal was also rejected - their stance is that because my ticket was not vaild due to the incorrect reg number being displayed, the charge is lawful.
I don't know whether to fight this through the small claims court or to pay a £100 fine over a £2 parking ticket (!!!!)

sorry , I dont believe that statement , Excel dont buy and "own" car parks, they are brought in as private contractors to monitor the correct use of the car parks on behalf of a Landholder or a Managing Agent. so unless you have written proof from the Land Registry that SRS or EXCEL "own" the car park, I wont believe you - sorry
I do believe they have been contracted to "run" the car park however
as the issues with parking ticket machines are well documented , the money was paid in good faith to park there and you have no control over said machines , let them take you to small claims court within 6 years and let a judge rubbish their claims and also rubbish the IAS kangaroo court decision too

Sorry, I didn't realise they don't 'own' the car park, this was just based off of what I have been told. My apologies!
Thank you for your help!0 -
no problem, just stick to the facts except do not reveal who was driving in cases like these
only state who the landholder is if you know for a fact , like a land registry document or a land agent tells you they brokered it for a client
anything you "heard" is mere hearsay, and whoever "told you" is either misleading you or probably lying , they have seen a sign and made unfounded assumptions0 -
Fight it if they try a claim, look, we've had this before:BedBlanket wrote: »I printed the ticket and noticed that the letter 'R' had been printed where the reg number was supposed to appear- the first woman in the queue had begun to enter her reg number before leaving the machine.

You need to read post #2 of the NEWBIES thread to be ready for the LBCCC, and the claim. We win over 99% of cases defended here, and yours is surely winnable.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
