    Was the letter addresses to ‘registered keeper’ and not your real name? I have recently received from DRP and they (almost) have spelt my name correct. The letter also says that if I refute to pay £160 they recommend court action to be taken against me, would I be right in saying this is clever wording on their behalf as DRP themselves cannot incite court action?

    You are right, DRP cannot initiate the court action.
    It appears that they are not proposing to either.

    They appear to be saying that they will recommend to the parking company that the parking company takes court action.

    And certainly not against someone who has no liability (the Keeper). Suggesting that they can is misleading and an aggressive and misleading practice that should be forwarded to Trading Standards.

    If you have the pockets for it and were not driving, you could issue a claim against both DRP and Smart as Smart are vicariously liable for the actions of their agent.

    The Scots case of Ferguson v British Gas is the leading one in this area.

    I’ve dealt with DRP once before a few years back and just looking for some reassurance that i won’t be the one unlucky guy that gets hit with a summon to the courts.

    Should I contact DRP from here?
